General conditions

Article 1: Preamble
These General Terms and Conditions of Sale (hereinafter the “GTC”) determine the rights and obligations of the parties in connection with the sale of Products and|or Services offered by the Service Provider: Jenyfer Bonnet.
Article 2: Acceptance of the conditions
Any Service provided to the Service Provider implies unreservedly the acceptance of the General Terms and Conditions of Sale by the purchaser.
Article 3: Conditions of Services
Any Service is deemed to have been completed and accepted after receipt of (i) the rental contract duly completed and signed by the Customer and (ii) the deposit paid by the Customer, the amount of which is 30% of the total amount of the Service. The deadline for payment of this deposit is set at one week (7 clear days) following the sending of the rental contract by email by the Service Provider.
The contract duly completed and signed by the Customer implies acceptance of all the conditions stipulated in the contract and these GCS, including the price and the Services, and acts as a Service voucher.Payment of the deposit by the Customer constitutes acceptance of all the conditions stipulated in the contract and these GCS, including the price and the Services, and acts as a Service voucher. After 7 clear days, the reservation becomes void if the deposit is not honored.
In the event of cancellation of the Service by the Customer no later than 48 hours after its acceptance, the Service Provider reserves the right to keep the deposit paid and to claim from the Customer the costs incurred for the performance of the Services, until the day of notification of the cancellation of the Service by the Customer. Any silence kept by the Customer after two (2) weeks following a formal notice sent by the Service Provider to the Customer by registered letter with acknowledgement of receipt will be treated as a cancellation of the Service by the Customer.
Article 4: Modification of Services
The modification of the reservation by the Customer must be notified to the Service Provider as soon as possible. A possible delay of the Service may be considered by the Service Provider under conditions of availability and acceptance of the new price of the service. If no solution is possible, see the conditions of Services.
Article 5: Rates
The prices shown are inclusive of VAT.
The Service Provider may from time to time allow the Customer to benefit from price reductions, discounts and discounts depending on the duration or regularity of the Services, according to the conditions set at its discretion. Any facility granted by the Service Provider does not constitute a waiver of the rights agreed to in these Terms and Conditions.
In the event that the Customer wishes to modify the scope of the Service during implementation and/or add additional time, a new contract may be submitted by the Service Provider in order to complete the previous agreement if this is deemed necessary by the Service Provider.
For each Service, an invoice can be established on request by the Service Provider for the Customer.
Article 6: Delivery
The Service will be provided in full by the Service Provider.
If the Service requires particular technical skills, the Service Provider will inform the Customer about the possibility of subcontracting part of it. The subcontractor will then intervene under the sole responsibility of the Service Provider, who undertakes to keep confidential all information of which the subcontractor will be aware when carrying out the Service.
The Service Provider will make its best efforts to comply with the deadlines announced. It is an obligation of means. If the Service Provider is unable to meet the deadlines announced, for any reason whatsoever, the Service Provider undertakes to let the Customer know as soon as possible and to inform him of the new deadline by any means. Under no circumstances can the Service Provider be held liable in the event of late delivery.
The Parties expressly agree to waive the provisions of article 1195 of the Civil Code.
Article 7: Payment and invoicing
The payment of the balance of the Service is made no later than one (1) month before the start of the rental. Payment facilities are at the discretion of the Service Provider.
Payments must be made by bank transfer.
In the event of total or partial non-payment of the Service on the date agreed on the rental contract, without the need for a reminder from the Service Provider, the Customer must pay the Service Provider a late payment penalty whose rate is equal to the rate applied by the European Central Bank for its refinancing operation increased by 10 percentage points as well as the legal fixed compensation of €40.
In the event of non-compliance, by the Customer, with these GCS, including the non-payment of even partial payments of an invoice, the Service Provider reserves the right to suspend the performance of the Services in progress without this non-performance being considered as being attributable to him. The Service Provider reserves the right to terminate the Services, even if not finalized, fifteen (15) days after the Customer receives a formal notice to pay and/or rectify the failure that has remained unsuccessful, without prejudice to its right to seek damages in court.
Article 8: Customer service
For any questions or information, the Customer may contact the Service Provider by telephone, email or post.
Article 9: Obligations of the Service Provider
The Services will be performed in strict compliance with the professional rules in use as well as, where applicable, in accordance with the conditions of the Service.
The Service Provider cannot be held liable by the Customer and the Customer may not seek damages against the Service Provider for delay in the performance of the Services.
The Customer acknowledges that the Service Provider is not bound by any obligation, and even less an obligation of result, in terms of moral, economic and | or commercial benefits for the benefit of the Customer, so that its responsibility cannot be incurred by the Customer if the latter is not satisfied with the impact of the Service Provider's Services.
Likewise, the Customer acknowledges that the Service Provider is not a tour operator, so that his responsibility cannot be incurred for any problem related to the progress of his stay outside of the Rental Services.
The liability of the Service Provider for any case other than those mentioned in these GCS is limited to the amount of the amounts paid to the Service Provider by the Customer until the occurrence of the event entailing the liability of the Service Provider and excludes in any case indirect damages.
Article 10: Obligations of the Customer
The Service Provider cannot be held liable in the event of non-compliance, by the Customer, with the internal regulations, these GCS, and without prejudice to the limiting liability clauses stipulated in these GCS.
In order to facilitate the proper execution of the Services, the Customer declares to be aware that the Service Provider is dependent on the precise definition of its needs, in particular the specificities related to its sector of activity, as well as on its cooperation throughout the execution of the Service, and thus undertakes to:
Provide the Service Provider with the information and elements necessary for the proper execution of the Service and within the requested deadlines. It also guarantees that it has the necessary rights to be able to use and modify these elements as part of the Service;
Take decisions within the defined deadlines and obtain the necessary hierarchical approvals in order not to delay the completion of the Service;
Warn the Service Provider of any possible difficulty relating to the execution of the Service;
Pay for the Service under the conditions specified in the contract and these Terms and Conditions;
Ensure that its moral, personal or commercial practices and relationships with third parties always comply with the laws, regulations and practices that govern these relationships;
Mention the name of the Service Provider in credits.
Article 11: Personal information and protection of personal data
The information and data provided by the Customer and collected by the Service Provider on the Site (such as in particular his name and surname, his contact details, the details of his Services) are treated in complete confidentiality and are saved in a database.
The Customer's personal data requested by the Service Provider, responsible for processing, are necessary for the registration, monitoring and archiving of its Services, for the commercial and marketing management of its file and for the quality of its relationships with the Service Provider.
The Customer's information and personal data are also kept by the Service Provider for security purposes, in order to comply with legal and regulatory obligations, and to allow the personalization of the services offered and the information sent to the Customer by the Service Provider.
Under the provisions of the Data Protection Act No. 78-17 of January 6, 1978 as amended, the Customer has the right to access, rectify, oppose and delete data concerning him. To exercise these rights, the Customer must send:

Article 12: Intellectual Property
The various elements of the site: brands, content, logos, logos, logos, logos, videos, videos, illustrations and images are protected by copyright, trademark law, patent law and image rights.

The Service Provider is only bound by an obligation of means with regard to the functioning and continuity of the site.
The Customer declares to accept the characteristics and limitations of an online service, and in particular to recognize:
that he is aware of the vagaries of online consultation, in particular with regard to response times;
that it is up to him to take all necessary measures to ensure that the technical characteristics of his computer and/or his computer network allow him to access the site;
that he is solely responsible for his access to the Internet;
that it is up to him to take all appropriate measures in order to protect his own data, personal data, works and/or software from contamination by possible computer viruses circulating on the Internet or contracted by any other electronic means;
that any telematic network used for data transmission purposes may experience periods of saturation due to bandwidth congestion, cuts due to technical incidents or maintenance interventions, decisions by companies managing said networks or any other events beyond the control of the Service Provider.
The Customer is solely responsible for the use he makes of the service and cannot hold the Service Provider responsible for any claim and/or procedure made against him.
Article 14: Applicable law
In the event of a dispute, an amicable solution will be sought before any legal recourse. The preliminary search for an amicable solution does not interrupt the deadlines for acting as a guarantee.
